Professional Liability Coverages

Long-Term Care Facility Professional Liability

Protection applies for your facility as well as to your nurses, student nurses, barbers, beauticians, social workers, medical director, and other health care professionals (physicians and surgeons are not insured for medical malpractice). Coverage includes: acts or omissions in the furnishing of nursing, social, and similar services that relate to the care of residents; handling of the deceased; violations of residents' rights; and undue influence of employees on residents.

Directors, Officers and Trustees

This errors and omissions policy protects your directors, officers, and trustees against lawsuits alleging matters such as: conflict of interest, failure to exercise good judgment, improper (but not dishonest) expenditures, exceeding authority granted by charter, and failure to honor an employment contract. Your organization also is covered if it is required to indemnify such individuals involved in the lawsuit.

Payment of court judgments and legal costs are provided if the claim is made while the policy is in force and if you had no prior knowledge of the wrongful act.

Employment Practices Liability

This policy protects you in three major areas relating to employees:

  • Discrimination - Employee lawsuits generally stem from an alleged failure to hire or promote, unjust demotion, discriminatory slurs or comments. An accusation is most likely based upon age, race, color, gender, national origin, religion, or disability.
  • Wrongful Termination - This involves terminating an employee in a manner which is against the law.
  • Sexual Harassment - This is defined as unwelcome sexual advances, requests for sexual favors, or other verbal, visual, or physical conduct of a sexual nature that are implied or presented as a condition of employment; are used as a basis for employment decisions; or create a work environment that interferes with job performance or creates an intimidating, hostile, or offensive working environment.
